Frequently Asked Questions

  •  I have not paid child support and now my baby's custodial parent won't allow me to see my child.  Is this legal?
    • It is not okay for a mother/father to avoid visitation just because the "other" parent is tardy on their child support.
  • My baby's non-custodial parent has not paid support, why can't I keep him from seeing his/her child?
    • You cannot correct one wrong with another.  If you want to have child support be an issue, then you must take that person to court and sue them. 
    • A child has a right to have and be supported by both parents.  It is never advisable to take the law into your own hands.
  • I gave my child school clothes and bought them books and paid for their soccer camp.  That should count against any arrearage for child support right?
    • No.  Child support is only the money given to the custodial parent for support of the child.  Anything that the non-custodial parent does not state as child support is considered by the court at a gift. 
    •  If you want those purchases considered child support then get an agreement in writing with the custodial parent.
  • My child has run away from home and the police say that there is nothing I can do?  Is that true?
    • No.  The parents can file a Family with Service Needs or FWSN.  Until your child turns 16 there is a lot of help that the courts can offer.  The process has been altered recently to provide more services rather than punishment.
